HAVING heard from Mr S Divekar on his own behalf and Ms D Hayes on behalf of the respondent, the Commission, pursuant to the powers conferred on it under the Industrial Relations Act 1979 (WA) (the Act), hereby orders –
1. THAT the part of the matter concerning the claim for annual leave loading in the sum of $337.73 in paragraph 2 of the claim be dismissed pursuant to s 27(1)(a) of the Act.
2. THAT the balance of the claim be listed for a hearing of one (1) hours’ duration on 6 May 2024 at 2.30 p.m.
3. THAT the parties are permitted to attend the hearing and give evidence by video link.
